1. Acceptance of Terms

By creating an account or using awfx.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our Medical Disclaimer, and our Acceptable Use Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use awfx.ai. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Service Description

awfx.ai provides subscription-based journaling, personal reflection, mood tracking, AI-powered companion features, community circles, and wellness resources. The Service is designed to support personal growth and self-awareness.

4. AI Feature Disclosure

awfx.ai uses artificial intelligence (via third-party AI providers xAI and OpenAI) to power features including the AI Companion, mood insights, weekly reviews, journal prompts, and safety checks. By using AI features, you acknowledge and consent that:

• Data shared with AI providers may include journal text, mood and wellness data, task/context data, AI conversation content, and community image URLs when moderation is used. This data may be sent to AI providers to generate responses, insights, summaries, recommendations, and safety checks.
• xAI (Grok) is the primary AI provider; OpenAI serves as backup.
• AI responses may be inaccurate, incomplete, biased, or inappropriate.
• AI responses are not professional advice of any kind.
• AI responses are not a diagnosis, treatment plan, or emergency intervention.
• You should not make medical, legal, or financial decisions based on AI responses.
• AI models may reflect biases present in their training data.
• Your data is not used to train public AI models.

We continuously update AI safety boundaries and disclosure language to align with evolving legal and regulatory expectations for consumer wellness AI.

5. User Accounts & Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You agree to use the platform lawfully and in accordance with our Acceptable Use Policy.
• You will not attempt unauthorized access to any part of the Service.
• You will not use the Service to harm, harass, or endanger others.
• You will not redistribute, reverse-engineer, or commercially exploit platform content.

6. User Content & Data Ownership

You own your content. Journal entries, reflections, and personal content you create on awfx.ai belong to you. By using the Service, you grant us a limited, non-exclusive license to process your content solely to deliver and improve the Service.

• We will never sell your personal journal content.
• We may use anonymized, aggregated data for product improvement.
• You can export all your data at any time in a standard format.
• You can delete your data at any time. Deletion is processed within 30 days, including backups.

7. Therapist Integration

If you choose to share journal entries with a therapist through the platform:

• Sharing is entirely voluntary and opt-in per therapist.
• You can revoke access at any time.
• awfx.ai is not responsible for your therapist's clinical decisions, advice, or conduct.
• Shared data is subject to both our Privacy Policy and your therapist's privacy practices.
• Shared data access follows our platform permissions and security controls.

8. Billing & Subscriptions

Paid plans are billed on recurring cycles through Stripe and/or platform app stores. By subscribing, you authorize recurring charges.

• Cancellation: You can cancel anytime from your billing settings. Access continues through the current paid period.
• Refunds: We offer a 7-day money-back guarantee on your first subscription. After that, no refunds for partial billing periods.
• Price changes: We will notify you at least 30 days before any price increase.
• Free tier: Limited features available at no cost; may change with 30 days' notice.

9. Community

Community Circles are peer-support spaces within awfx.ai. By participating, you agree to our Acceptable Use Policy. We moderate content but do not guarantee review of all posts. Users are solely responsible for their own contributions.

You agree to indemnify and hold harmless awfx.ai, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your content or conduct, or (d) your violation of any third-party rights.

12. Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Individual basis only: You waive any right to participate in a class action or class-wide arbitration.
• Small claims exception: Either party may bring claims in small claims court (up to $10,000).
• Informal resolution first: Before filing arbitration, contact us at support@awfx.ai. We will attempt to resolve disputes informally for 30 days.
• Opt-out: You may opt out of this arbitration clause within 30 days of accepting these Terms by emailing support@awfx.ai.
• Costs: For claims under $10,000, we will pay your arbitration filing fees.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Termination

We may suspend or terminate your account if you violate these Terms, with notice where practicable. You may delete your account at any time. Upon termination, your data will be handled per our Privacy Policy retention schedule.

15. Modifications

We may update these Terms from time to time. Material changes will be communicated via email and/or in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance. If you disagree, you may delete your account.
